How I lost my job
  • I received my payroll check because we were going through payroll company changes. I took it to the drive up teller and made my deposit.
    The next day I found out from other co workers our boss did not sign the checks. I then returned to the bank to let them know what had happened and asked that my check be returned to me as I was told by the bank our work banks with would cash the check and have our boss sign it when she returned from out of town.
    I was told by the teller that the checks had already Batched and she was not sure if it could be returned.
    After my two hour wait, the teller returned my check, I asked her if I needed to sign anything and she said no everything was taken care of. I then cashed the check and returned to Bank of America to make my deposit. I thought nothing more of it.
    Now after nearly 6 months later I was fired and being investigated for FRAUD!!!! Why you ask?? Some how the check clear the account even though it was returned to me.
    I was told that there were duplicate checks from what I could tell one was endorsed be me on the back and the other which appeared to be a scanned copy was not, all it showed was a BOFA stamp on the back and a date. I was told that I deposited this check through the ATM which I DID NOT. I asked that they pull up video from the cameras they would be able to see that I went through the teller the night before and the check was returned to me the next morning, only to be told they do not keep video.
    I was told by the branch manager unless I can produce a deposit slip there was nothing they could do for me. She said that since the check was deposited through the ATM there would have been no way for they to give it back to me because they had no access to it. I repeated I did not go through the ATM i went through the teller.
    I have now had to retain an attorney , I feel like I am in a nightmare and cant wake up. The most curious thing is all of my ATM deposits show a deposit receipt and this does not it looks like a cash deposit.
    I do take responsibility for not keeping up with my statements and noticing the money in there, but it is still there I never spent a dime of it.
    I think BOFA is just trying to cover there asses for screwing up in the first place.
