Why Bank of America is the Devil
  • My house went to trustee’s sale today at 10 am PST. This only happened after BOA made several admitted errors in handling my foreclosure.
    In 2009 my income was reduced by 150% and I became delinquent on in payments for my house that was overvalued to $600,000+ in May of 2010. My loan balance was approximately $420,000.
    Over the course of 12 months I tried several time to get a loan modification. I was finally approved for a loan mod late December 2010 that made my payments slightly more than they were previously, thus making a modification irrelevant. I quickly denied that modification in writing and continued to negotiate with BOA on an affordable option to stay in my home.
    In June it became apparent that a loan modification was not going to be possible and had a pending trustee’s sale date so I perused a short sale.
    I was told originally to peruse a HAFA short sale which I promptly did. I was told a few days later that I did not qualify for HAFA because I had a sale date. So they told me I was preliminarily approved for a Cooperative short sale. We received an offer on the house the very same day it went on the market and submitted it per there guidelines. A week later we found out that BOA had by mistake put me back into the HAFA program and subsequently I was denied again. After several phone calls to managers and other people at BOA I got put back into the cooperative short sale program. After waiting the 10 days they said (while maintaining constant contact with BOA) it would take to get the paperwork sorted out, I was denied for a coop as they claimed it was too close to the sale date I had previously asked for a postponed sale date several times). So they decided to put me in for a conventional short sale July 5th. I then requested an extension of the sale and had my realtor re-upload the offer. On Wednesday July 6th BOA informed me that the request for extension was denied because they didn’t have an offer on the house which they did find on Thursday July 7th and admitted that it was there but they made a mistake. On July 7th I requested again a postponement of the sale date. On July 8th I called again and they said they had no record of a request for postponement of the sale date so I requested it again.
    This morning July 11th, the day of the sale, I called again. BOA informed me that they sent the request to the wrong company for postponement of the sale and that it should have gone to ReconTrust in lieu of McCarthy/Holthus (who they sent it to). Needless to say my house went to trustee’s sale 41 minutes ago.
