My original mortgage was in 1999 with accubanc Mortgage corp. In the assignment they assignee is Impac funding corp in the discharge of this mortgage they have Bankers trust company as the holder of the mortgage. Something does not seem right there. Then we refinanced 4 more times with no assignments being recorded. Our final refinance was with Greenpoint mortgage they sold to countrywide, then as you all know it ended up with BOA. We have been trying to modify for our property value has decrease signficantly. As of 2 weeks ago they declined us, no surprise. But what was a surprise is that they recorded an assignment on our property and had Greenpoint as the original mortgagee. Greenpoint originated in 2003. Greenpoint is no longer in business. Does the bank have to prove they are the holders of the note?
