BOA LOAN MODIFICATION - Anyone have any advice - Lost
  • This bank is somthing else. I did a loan modification and this bank almost a year later keeps moving money around on the account to always end up saying I am a month behind. The agreement was for 3.25 and they charged 3.875 for 7 months after the modification date. I went through payment research about 3 months ago and they saw the problem and fixed it. Then the modfication people moved all my money around again to say I am now once again a month behind. I have never missed a payment. When they do this each time they apply late fees to the account.

    Anyone have any advice, they are driving me nuts and really are stealing my money. I spend hours and hours on the phone to always have the wrond department. They always transfer to me to someone who claims I have once again the wrong department. It is almost like they are laughing in my face, they all acknowledge all the note and agree how screwed up the account is, but offer no resolution.

    I hope someone else is having some problems and can point me in a good direction. There has to be some kind of legal issue with them always moving and reapplying funds in different ways.

    I will check my post daily and hope there is some advice.

  • did you get a boa modification because they said you didn't qualify for a HAMP? there's only 4 requirements. you have to live in the home. you have to owe less than 700 thousand and something, your mortage must be from before 2009 and your mortgage, including taxes and insurance, must be over 31 or 33%. i never remember which one. my pay was reduced so much that my mortgage was almost 50% of my income. do the math and see if you qualify. if it's a boa modification, i can't help you and i'm sorry you have to deal with this. by the way, the HAMP rate is 2.65%. good luck.

    Try to see if you can qualify for an in-house modification that has better rates and a more benevolent features. It takes a long time, there are millions upon millions. We have some friends and their parents who are on fixed incomes and not underwater, just could not handle the high interest rates, did get a modification, and yes it was from BofA, and they were not behind on their payments. They just had a mortgage of $267,000 at about 7.125% that they got in 2007, and it took them 9 months and now they are on the 2nd month of their trial modification that is at 2.125%.

    Did it take them a lot of time and a good deal of "hands on"? Yes, it did. But they did not have any issues where items or where a whole file was lost. They only thing they had to do was fax documents more than once because not all pages were rec'd. Trivial things like that, but they were hands on, and succeeded. Half way through, the took my advice and copied someone at Barbara Desoer's office with every document they sent to the modification specialists. Through Desoers office, they had someone assigned to their modification that followed it through to the trial stage. The bank, this bank, any bank, does not want to become a homeowner or a landlord--lets be real here.

    Our friend Denise Richardson of givemebackmycredit.com has posted an article about one homeowner’s successful fight against the system to get a mortgage modification that will benefit her for many years to come.

    Maria of Lexington, Kentucky says that she finally obtained a mortgage modification under the government’s Home Affordable Modification Program (HAMP) plan after battling for over a year with Bank of America. Her HAMP modification starts with 2% interest and tops out at 4.75% during years 8 to 32. The payment plan is for a long time period, but the modification has lessened the payment to an amount that is affordable on her income.

    She was almost “duped” into signing a modification contract with Bank of America that would lower her interest rate from 6.75% to 4.75%. This sounds like a good thing, but when you add on fees and the escrow in the principal, her actual monthly payment only decreased $1 from the original amount, which is basically useless.

    It took Maria 18 months to actually get the B of A contract physically in her hands and the instructions were for her to sign and return it within 11 days with a check for the December 1st payment.

    I had already made November’s trial modification payment, was this to be December 1st payment? They didn’t indicate how it was to be credited, plus November’s payment had not been credited to the contract balance.Panic.. 10 days to read all the new terms and legalize. After reviewing, as best as I could, I had four basic questions I needed answers to. Oh no, not the Alice and Wonderland phone torture test again! Got to. Three and a half hours later, transferred from one department to another, disconnections, out-right misinformation, and threats of foreclosure if I did not sign and return by November 23 deadline. I had the answer to my first question, I think? For the next 5 days, I would have anywhere from 4 or 5 messages from B of A asking if I had signed and mailed their modification. What’s going on?

    Maria had signed up for Lexington’s Community Ventures, a nonprofit, Making Home Affordable assistance program, and faxed the B of A documents to her case worker. The case worker responded a few days before the deadline stating that B o A’s modification “didn’t look like” HAMP. 48 hours before the deadline, another B of A package showed up only this time it clearly showed that it was legitimately a HAMP modification.

    “With all kinds of RED flags waving and fast, fast pressure, I guess I should have realized sooner that this was some kind of scam, but still, Bank of America?I believe that Bank of America has completely and utterly spat on Obama’s Making Home Affordable program with total disregard for the spirit (if not the legal) design to help home owners in distress. Next time they need a taxpayer bailout….let them suffer the consequences of their own greedy business decisions.”

  • I have been waiting for nearly a year and a half to GET the loan modification! They keep changing the rules. According to HAMP guidelines, I am fully qualified, but BofAhole has its own internal rules they change on a regular basis. I could not get a person on the phone. They did not communicate with me at all. I am one of those people who was with Countrywide, but got swallowed up by this banking monster. I am continuing to pay my mortgage, but it is tighter and tighter every month, and the credit cards at the end of the month are the only way I can make it through (one of which is now BofAhole too, because they swallowed up MBNA).
    I finally got fed up, and sent a complaint to my states' attorney general. Funny, about a week later, I got a call from BofAhole "vice president of customer relations" (yeah right). "We are working on your account, and are sorry you are having so much trouble. We are behind in our processing, so it is taking time to get through....bla...bla...bla...". "We are assigning (specific person) to your account, and he will be in touch within a week."
    4 weeks later, he calls, I am not home, so he leaves a message that I should call him back to get the status on my loan. Once again, I can get no response, even though his voice mail says "I will return your call within 24 hours". I STILL do not know the status of my account.
    Your experience is helpful (sorry you are going through it), so I can try to make sure I do not get that treatment IF and WHEN I get approved.
    My father, 30 years ago said "NEVER bank with bank of america...never get your mortgage through them...they will screw you". Unfortunately, I got them not by choice, but through buy-out.
    They are so big, I don't think there is anything we can do, short of a class-action suit, but who has that kind of money?!

    The "we are over worked" excuse does not cut it. Had it not been for TARP, there would be no BofA! They are simply evil and don't want to help! :evil:
  • I got a modification 8 months ago. We were in court with BOA attorney, and BAC home loan servicing. They signed off on everything for the modification. I have made my payments for 8 months, and they still have us in foreclosure, and when I call in, there is no modifcation in place. Yet, I have court documents where they agreed, settled and accepted us into this modifcation. When I call in, they have placed our money into a holding account? Nothing is being applied. My year end statement was sent in January for taxe purposes. I filed my taxes, used my mortgage statement ( interest). Now, I recieved another mortgage statement yesterday saying they took it all back? I am tired of calling in and not getting any answers!! No one listens, no one helps. I am ready to sue.
  • I have been dealing with BofA since October of 2010 to try and get a loan modification. My job was eliminated in May of 2010, severance pay ended in November 2010 and now I'm on unemployment; which is not enough to pay utilities and the mortgage. I call BofA about twice a week to get updates and the BofA representatives never have consistent answers. It's almost as if each representative is just making things up. I have never gotten a call from BofA asking for information or giving me any indication that anyone at BofA is actually doing anything. I even had a BofA representative named "Luis" threaten to remove me from being considered for any type of loan modification program consideration. I've read some of the other posts here where people say they've had almost a year before forclosure.....not me. BofA had my home listed to go on a sheriff's sale within four missed payments; mid February I was notified that my home would go up sale on March 28th, 2011.

    Like circling vultures waiting for an animal to die, I have received mail from the following realtors saying they saw my home was listed to be foreclosed on and would "help":

  • I am in the same situation as everyone on here. I have read even more on other boards. If I explained all my crap with the loan mod, I'd have a freakin book! I have some email addresses that have at least gotten me some contact. I still don't have a mod, but I'm not giving up! Last time I included people at the Fed.

    I cannot get anyone at BOA to explain the insane accounting they have used on my account. I starting printing out my transaction history on-line as often as they changed it....so check everyday. If they can't explain how they applied my money, it's fraud! They keep throwing a new person at you to prolong whatever their plan is.

    The best communication is to get email going with someone. At least you'll have a trail of documentation because they all lie or are incompetent. I told one rep I was going to record the conversation and she said she would have to hang up. I have been working with "The Office of the President" for 9 months...they suck too! But I am not giving up! I stopped paying them 3 months ago and they haven't asked for any money either on the phone or in written correspondence.

    These email addresses have gotten me some attention. GOOD LUCK!!

  • ;} I used Universal Lending to execute a modification (FTC closed their operations for fraud), then had to do it on my own. I had a friend who offered to finance the home, but after three months Bank of America still hadn't responded to multiple requests for payoff. We contacted the attorney in Monroe Louisiana who was handling the forclosure and was told they couldn't get an answer either. They finally sent me a modification just days before my home was up for auction. I signed them and sent them back FedEX. Two days later I recieved another offer. I called and told them I had sent the package off, and was told that it contained an adjustable rate and they could get it waived.. It also added back interest of over $18,000 to the balance due of $118,000 making the total due of over $145,000. Since I was caught between the old rock and hardplace, I told them to go ahead with it and was put on a trial period. I fulfilled the period, (supposedly 3 months, but took over 6 months) and was sent a letter saying I qualify for the modification. The letter also in multiple places said they were preparing Agreement papers and as soon as I got them get them back in the time period stated. The wording actually was "to accept this offer, you will need to sign and return a Modification Agreement that includes the terms and conditions of the permanent modification. We are in the process of preparing your Agreement and will be sending it to you soon. Please be on the lookout for a package in the mail and return the Agreement to us by the requested date so we may finalize you loan modification". I did not recieve them within 4 weeks so I called on and was told if not recieved by June 23, 2010 call back. I waited til June 23 and still no packet. I called and was assured it was "APPROVED" but they were running behind pretty badly. They said call back if not recieved by July 23, 2010. No packet so I called on July 25,2010. Again I was assured it was "APPROVED" and not to worry, it was taking several months to get all the paperwork out. I was told to just continue making the modification agreement payments as I had been doing. I was disabled in Janruary of 2010 and put on weekly disability payments. In Oct 2010 I was put on monthly payments paid on the 21st day of the month so I called and talked to John on the 5th day of December at 12:53 CDT. I explained the situation and he said don't worry, it would not change anything. He asked if I could afford the modification payments where they were and I told him yes. He also told me I could use direct pay by my bank at that time. He also assured me I was approved for modification and would see my paper work soon. On February 23, 2011 I recieved a call from BOA. I returned the call and was told I had been turned down. They transfered me to the DESIREE TEAM. I talked with a supervisor named Julie Nye. She said my payment was $1184.96. I explained that I had been approved each of my statements showed to continue the $983.32 Payments. She asked me to fax all that to her and she would post it to my folder. I also asked her about the turn down, and she said it did not reference that in my account. She said it showed I was still under "REVIEW". I explained the approval letter and she asked that it be sent also. Then last night, February 23, 2010 I recieved another call from another dept of BOA. I was told I had been turned down and I would be sent another packet. She also said not to be surprised if I recieved a forclosure notice and not to ignore them. She said they were sending me another package to see what other program I qualify for. So eleven months after I was sent an approval letter , and over 18 months since the process started they are now wanting to steal my home. I am now on permanent disability and would probably not qualify for any program. Where do I go from here? I have already went to the Federal Trade Commission and Louisiana's AG One good way of dealing with this senior Enron group is email every exec in BOA, The federal trade commission, US Attorney General, State Attorney General, All US Senators and congressmen from your state and your State Attorney General.. Title the email "Bank of America Modification Fraud. Also go to www.makinghomeaffordable.gov. They are a free service and are totallly familiar with the modification laws and will contact BOA with you on the phone and work with you/them to settle this scam BOA is doing.
